Debt Collection and Workout

My expertise in the field of debt collection was established in my work as a judge candidate, where I adjudicated enforcement, liquidation and bankruptcy cases independently. This experience has been further developed through my legal services to a number of commercial banks, debt collection companies, and other business entities and individuals, first as an in-house legal counsel and then as an attorney.

My main services in this framework include:

  • legal representation in pre-litigation proceedings, attempting to enforce a claim out of court (facilitating negotiations between the two parties, preparing debt acknowledgements, debt assumptions, settlements, and payment notices)
  • legal representation in civil lawsuits for the enforcement of claims, order for payment proceedings, enforcement proceedings, bankruptcy and liquidation proceedings
  • enforcement of claims against third parties other than the debtor (in particular mortgagors, suretors, members of companies, persons concluding contracts to conceal assets)
  • incorporation of such instruments and collaterals in the contracts that facilitate the voluntary performance of the debtor (e.g. mortgage, surety, bank guarantee, security deposit, earnest)
  • legal support for the restructuring of credit, loan, leasing and related collateral contracts
  • legal support for assignment of claims and pre-transaction due diligence
  • drafting payment agreements (e.g. instalment agreements) and related unilateral declarations (e.g. debt acknowledgement) for non-performing debtors
  • assisting debt management companies in the development of debt recovery processes and in the review and optimisation of existing recovery processes
  • developing legal aspects (e.g. process, legal documents) of alternative methods of selling receivables (e.g. competitive selection process based on price, electronic auction)
